1. Overview

This Privacy Policy explains how NagaAI (the “Company”, “we”, “us”, or “our”) collects, uses, and shares information when you use our website and services (the “Service”).

Key point: For Paid Models, we do not collect or use your prompts and responses for Training unless you explicitly opt in via your privacy settings. For Free Models, Training data collection is enabled.

2. Definitions

  • “Service Data” means the prompts, inputs, files, and other content you submit to AI models through the Service, and the outputs you receive.
  • “Free Models” means models offered by us at no cost (free tier) on the platform.
  • “Paid Models” means models that require payment or credits to use.
  • “Training” means using data to train, fine-tune, evaluate, or improve AI models and related systems.
  • “Partners” means third-party model providers and service providers we work with to operate the Service or provide models.

3. Service Data Collection & Training Preferences

We handle Service Data differently depending on the model type you use and your privacy settings. For Paid Models, your privacy setting controls whether Service Data may be used for Training, and we require Partners involved in providing those Paid Models to honor that setting.

  • Free Models: Service Data may be collected and used by us and our Partners for Training and improvement of the Free Models we provide on our platform. This is always enabled for Free Models, although specific Training practices may vary by the Free Model and Partner.
  • Paid Models (default): Service Data is used to fulfill your request (provide the output) and is not collected or used for Training by default.
  • Paid Models (optional, opt-in): If you enable the “Training on paid models” setting in your account privacy settings, Service Data from Paid Model requests may be collected and used by us and/or our Partners for Training and improvement. If you do not enable this setting, we do not permit Partners to use that Paid Model Service Data for Training.

Your privacy settings apply prospectively. If you change your preferences, the change will affect future requests after the setting is saved.

4. Information We Collect

We collect information in the following categories:

  • Account Information: such as your name, email address, authentication identifiers, and account preferences.
  • Payment Information: payments are handled by our payment processors (e.g., Stripe). We do not store your full card details on our systems, but we may receive transaction metadata (e.g., payment status, timestamps, and limited billing details).
  • Service Data: collected only in the cases described in Section 3 (Free Models and opt-in Paid Models).
  • Operational & Security Data: limited logs needed to operate and secure the Service (e.g., rate limiting, abuse prevention, error diagnostics). These logs may include timestamps, device/browser information, and network identifiers.
  • Aggregated Usage Data: we may collect anonymous, aggregated data (e.g., which models are most popular) to improve the Service. This data is not intended to identify you.

5. How We Use Information

We use information to:

  • Provide and maintain the Service.
  • Authenticate users and administer accounts.
  • Process transactions and manage credits/subscriptions.
  • Prevent fraud, abuse, and security incidents, and troubleshoot reliability issues.
  • Train and improve Free Models and (only if you opt in) Paid Model experiences and related systems.
  • Comply with legal obligations and enforce our terms.

6. How We Share Information

We may share information with the following categories of recipients:

  • Model providers / Partners: to provide model inference. Service Data may also be shared for Training only for Free Models and opt-in Paid Models, consistent with Section 3. For Paid Models, our intent is that Partners use Service Data for Training only when you have enabled the applicable privacy setting.
  • Vendors and service providers: that help us operate the Service (e.g., hosting, analytics, email delivery, payment processing), subject to contractual confidentiality and security obligations.
  • Legal and compliance: if required by law, legal process, or to protect rights, safety, and security of the Company and users.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets.

We do not sell your personal information in the traditional sense (i.e., for money in exchange for marketing lists).

7. Data Retention

We retain information only for as long as necessary for the purposes described in this policy, including to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements.

Retention for Service Data depends on whether it is collected under Section 3 (Free Models or opt-in Paid Models). When Training is not enabled (Paid Models by default), we aim to minimize collection and retention of Service Data beyond what is required to fulfill your request and operate the Service.

8. Security

We implement industry-standard technical and organizational measures designed to protect information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights & Choices

  • Training preference for Paid Models: you can enable or disable Training for Paid Models in your account privacy settings.
  • Access/Correction/Deletion: depending on your jurisdiction, you may have rights to access, correct, or delete certain personal information.
  • Account closure: you may request account closure; certain information may be retained as required by law or for legitimate business purposes (e.g., fraud prevention).
